Peeyakorn Leankattava, an SJD candidate at the KoGuan School of Law of Shanghai Jiao Tong University, was recently awarded an academic grant by the Southeast Asia Justice Lab at the University of Wisconsin-Madison. She delivered a presentation titled“Freedom of Expression vs Privacy Rights: Thai and Chinese Laws Relating to Facebook's Notice and Takedown Provisions”, under the mentorship of Professor Shen Wei, at the “Article 112 Project” Online Conference held on May 7th, 2024.
From the perspective of how online platforms such as Facebook balance freedom of expression and privacy rights through Notice and Takedown measures, she explored the balance between journalistic exemptions on data protection and freedom of expression. Employing comparative and case study methods, Peeyakorn argued that Thailand lacks specific data protection laws regarding Notice and Takedown measures, in contrast with China's incorporation of privacy rights into its civil law systems. She emphasizes the critical need for legal clarity regarding the liability of Internet intermediaries in Thailand, suggesting that under the mere-conduit principle, platforms such as Facebook should not be overburdened with the responsibility of proactive content monitoring and censorship. This presentation received recognition and approval from attendees and the committee at the conference.
