Grand Justice Hu Yunteng Visited KoGuan School of Law

On 21 October 2021, in order to further study and implement Xi Jinping's Thought on the Rule of Law as well as celebrate the 20th anniversary of the founding of KoGuan School of Law, the first lecture of the Expert Forum was held in the KoGuan School of Law's Dongfang Assembly Hall. China's leading jurist Hu Yunteng, President of China Case Study Law Society, Former member of the Judicial Committee of the Supreme People's Court and Grand Justice of the Second Rank, delivered an enlightening lecture themed on "the History and Judicial Practice of the Principle of No Punishment for Doubtful Cases.”Hosted by Professor Kong Xiangjun (Dean of the KoGuan School of Law), the lecture was attended by Wang Houji (Party Secretary of the KoGuan School of Law), Professor Peng Chengxin (Vice Dean of the KoGuan School of Law), Professor Shen Guoming and Professor Zhang Shaoqian.

Dean Kong Xiangjun illustrated the significance of holding the Expert Forum. Xi's Thought on the Rule of Law is a basic principle for us to promote the high-quality development of legal education and cultivate talent. Simultaneously, it also marked the beginning of a series of activities that celebrate the 20th anniversary of the founding of the KoGuan School of Law. Accordingly, the KoGuan School of Law extended its warmest welcome to Justice Hu Yunteng for attending the Expert Forum.

Justice Hu Yunteng praised the achievements of the KoGuan School of Law over the past two decades, and encouraged the law school to continue its efforts to promote the development of legal education in China. In his lecture, Hu started with a brief introduction to the categories, nature, existing stages and solutions of "doubtful cases," as well as defining "the principle of no punishment for doubtful cases." Then, he introduced the principle's judicial application prior to the founding of modern China. He concluded by emphatically discussing contemporary development and application of the principle, using the 2012 and 2018 Criminal Procedure Law Interpretations as case studies.

In the subsequent Q&A session, students raised questions on the principle's application standards and enforcement difficulties. Hu Yunteng gave a professional answer to this, and told the students to firmly believe in the rule of law and become high-quality legal talent needed by the country in the new era.

Dean Kong Xiangjun concluded by stating that the life of the law lies in experiences. Hu's all-round specialized interpretation of the principle of no punishment for doubtful cases is enlightening for us all, and the gratefulness of all KoGuan School of Law's students and faculty are beyond words.
