Professor HU Jiaxiang Participated in the Gaidar Forum and Conducted Academic Exchanges in Russia

404At the invitation of the Russian government, Professor HU Jiaxiang from KoGuan School of Law, Shanghai Jiao Tong University, participated in the Gaidar Forum, known as “the Russian Davos Forum”, as a member of the Chinese delegation on January 14 and 15, 2020 in Moscow. The theme of this forum is “Russia and the World: Challenges of the New Decade”. Nearly a thousand officials and professionals from the political, academic and business communities around the world were invited to discuss the current problems facing Russia and the world’s economy.

This forum is the 11th Gaidar Forum and China’s first participation in the sub-forum. KoGuan School of Law, Shanghai Jiao Tong University, the China-Shanghai Cooperation Organization Legal Service Committee Exchange and Cooperation and Russian Presidential Academy of National Economy and Public Administration, jointly hosted the sub-forum themed “Eurasia’s New Geopolitical Pattern: Linking China’s Belt and Road Initiative and Russia’s Eurasian Economic Union”.

In the sub-forum, Professor HU Jiaxiang from KoGuan School of Law, Shanghai Jiao Tong University spoke first. He shared opinions on the dispute resolution mechanism and organizational issues in the implementation of the Belt and Road. He believed the countries along the Belt and Road and the countries of the Eurasian Economic Union currently do not have effective dispute settlement mechanisms, none of the existing international dispute settlement mechanisms can effectively resolve such disputes, and to establish dispute settlement mechanisms between the countries along the Belt and Road and the countries of the Eurasian Economic Union is an effective guarantee for promoting bilateral cooperation.

Professor XU Guojian, Distinguished Dean of the School of International Law, Shanghai University of Political Science and Law, explained the basic theoretical issues, systematically introduced the current status and latest developments of the international dispute settlement mechanism, and shared the process and inspiration for his personal participation in the drafting of the Singapore Convention on Mediation and the Hague Convention. Dean XU Guojian pointed out that the dispute settlement mechanism is not only a guarantee mechanism for linking the Belt and Road initiative and the Eurasian Economic Union, but also a dispute prevention mechanism for cooperation between the countries along the Belt and Road and the countries of the Eurasian Economic Union. He put forward the concrete idea of establishing a regional dispute resolution mechanism within the scope of the Shanghai Cooperation Organization.

CAO Junjin, associate professor of the School of International Law, Shanghai University of Political Science and Law, first responded to some international speakers’ misunderstandings of China’s Belt and Road Initiative, arguing that differences in legal systems caused by economic, political, historical and cultural differences are inevitable, and legal cooperation can effectively eliminate differences in economic and trade cooperation and reduce economic and trade disputes in the process of linking the Belt and Road Initiative and the Eurasian Economic Union. Professor CAO proposed that the cooperation between China and the member states of the Eurasian Economic Union should be further strengthened in terms of the legal system’s top-level system design, industry legal exchanges, and legal personnel training cooperation.

The Vice President of the Russian Presidential Academy of National Economy and Public Administration, the Director of the Trade Policy Division of the Eurasian Economic Union Commission, the Chairman of Kazakhstan Astana Civil Service Hub, the President of Kyrgyz Presidential National Academy of Administration, and the President of Tajikistan Presidential National Academy of Administration, all expressed the recognition, appreciation, support and expectation of linking the Belt and Road Initiative and the Eurasian Economic Union.

During the visit to Russia, the delegation also went to the Chinese Embassy in Russia, visited ZHANG Hanhui, the Chinese ambassador to Russia, and reported on the itinerary and content of the visit to Russia. Ambassador ZHANG Hanhui briefed the delegation on the current status of economic and trade cooperation between China and Russia, stressed the importance of improving legal service in the process of Sino-Russian economic and trade cooperation, and made comments and suggestions on further exerting the role of the Shanghai Cooperation Organization Legal Service Committee. The two sides also conducted in-depth exchanges on linking the Belt and Road Initiative and the Eurasian Economic Union and Sino-Russian cultural exchanges.

On the eve of the forum, the delegation also paid a visit to the Russian Presidential Academy of National Economy and Public Administration, and conducted in-depth exchanges on topics such as linking the Belt and Road Initiative and the Eurasian Economic Union, Shanghai Cooperation Organization economic and trade cooperation and the training of political and legal talents, and the training of political and legal talents with the Vice President of the Russian Presidential Academy of National Economy and Public Administration, the President of Kyrgyz Presidential National Academy of Administration and the President of Tajikistan Presidential National Academy of Administration.

On the morning of January 16th, the delegation took advantage of a gap between meetings to make a special trip to the All-Russian State University of Justice in downtown Moscow, and conducted extensive discussions with the University’s Vice President in charge of foreign cooperation and the Director of the International Exchange Office on legal education cooperation between China and Russia.

Because of the great geographical convenience and economic complementarity of linking the Belt and Road initiative and the Eurasian Economic Union, it has been highly valued by all parties in cooperation in recent years, and has become an important issue during the exchange of visits between Chinese, Russian and Central Asian leaders. At present, China has signed a cooperation framework document with the Eurasian Economic Union and formed an overall institutional arrangement. However, the deep integration of the Belt and Road Initiative with the Eurasian Economic Union still needs further research and discussion. The viewpoint put forward by the Chinese delegation at the Gaidar Forum provided ideas for linking Belt and Road Initiative and the Eurasian Economic Union. At the same time, it further demonstrated the scientific strength of Chinese scholars and enhanced the international influence of Chinese universities.
