KoGuan School of Law, Shanghai Jiao Tong University Team Won the Success in 2017-2018 Asia Pacific Moot Court Competitions, International Trademark Association

From February 23 to February 24, 2017-2018 Asia Pacific Moot Court Competitions, International Trademark Association was held inSingapore Management University. The competitions brought together 23teams of outstanding students from China, India, Singapore, Philippines, Czech, Vietnam, Malaysia and other countries.The participants were mostly native speakers of English from continental law system and common law system countries.

After fierce competitions, KoGuan School of Law, Shanghai Jiao Tong University won the honors of “Second Best Brief” and “Fourth Place In The Oral Argument”. Shanghai Jiao Tong University team consisted of seven students from KoGuan School of Law. They were Xu Yongkang, Chen Yi, Ma Chenyun, Royal Seng (Cambodian), Qi Yiceng, Li Wangfangyan, Xiao Yao. The instructors were Dr. Liu Yongpei and Dr. Wang Jie.

In the preliminary grounds, Shanghai Jiao Tong University was in the same group with Diplomatic Academy of Vietnam, Hanoi Law University, School of Law, SASTRA, and San Beda International Law Society. After two rounds of competitions, Shanghai Jiao Tong University made to the final eight.

In the quarterfinal, Shanghai Jiao Tong University team performed excellently and eliminated Symbiosis Law School team, while in the semifinal, lost a slight margin to National University of Singapore team, finally winning the fourth prize in oral argument. There were three universities of mainland China participating in the competitions, including Shanghai Jiao Tong University, Renmin University of China, Guangdong University of Foreign Studies, among which only Shanghai Jiao Tong University entered the semifinal. The outstanding performance of Shanghai Jiao Tong University team, especially Xu Yongkang and Chen Yi, gained the acclaim from presiding judges and INTA officials.

According to competition rules, all the participants should be law school students without law degrees. Under the guidance of Dr. Liu Yongpei and Dr. Wang Jie, the team members overcame various difficulties like lack of experience, inadequate professional learning period and weak foundation. They studied cases conscientiously, had discussion and pre-match simulation weekly as well. Through tremendous effort of reading articles, cases and documents retrieval, careful demonstration organization, repeated scrutiny, Shanghai Jiao Tong University team debated around likelihood of confusion, earlier right and preliminary injunctions, and other core issues of trademark law according to the specific case, resulting in the impressive award.

INTA's Moot Court Competitions are international trademark law competitions organized by the International Trademark Association, aiming to concern core issues of trademark law and unfair competition law. Open to the law school student teams recognized by the US, Moot Court Competitions in the US is an unprecedented event with about 80 teams of law school students taking part in each year. After the success holding in the US, the INTA extended the competition out of the United States in 2018, hosted the first Asia Pacific Moot Court Competitions in Singapore from February 23 to February 24, opening for law schools outside the US. During economic globalization, the competitions were supposed to lead law school students to observe hot spots and difficulties of trademark law and unfair competition law from a global perspective, accelerate the prosperity of theory and practice of intellectual property law in Asia Pacific region, promote mutual understanding and academic exchanges of participating teams, and cultivate specialized personnel of trademark law.

According to the judging disputes of first trial, competitors were required to participate in the appeal trial on the behalf of appellant and appellee, debating in the language of English, while judges would ask questions related to the claims and briefs of all parties. The competitions placed high demand of the whole demonstration idea, on-the-spot flexibility, legal English expression and comprehensive competence of legal research.

Recalling the competition, Shanghai Jiao Tong University team conducts fierce and exciting debating with the legal elites from famous universities at home and abroad, showing the high qualities of students, as well as the satisfying effect of cultivating legal compound talents in KoGuan School of Law, Shanghai Jiao Tong University. At the same time, this competition fills the blank of high-level international competitions in the field of intellectual property, adding a great significance to the internationalization practice of intellectual property of KoGuan School of Law, Shanghai Jiao Tong University. We are looking forward to having more students join the Moot Court Competitions of International Trademark Association, achieving enhancement of legal literacy and accumulation of practical experience.
