Shanghai Jiao Tong University - University of Washington Seminar on Intellectual Property and Competition Law was successfully held

On May 27, 2015, Shanghai Jiao Tong University - Washington University Seminar on Intellectual Property and Competition Law was held at KoGuan School of Law of Shanghai Jiao Tong University. The conference was organized by KoGuan School of Law of Shanghai Jiao Tong University and Law School of Washington University and undertaken by Shanghai Jiao Tong University Intellectual Property Research Center, Shanghai Jiao Tong University Competition Law and Policy Research Center, and Shanghai Jiao Tong University KoGuan School of Law Asian Law Center. Experts and scholars from the Australian Federal Court, the Supreme People's Court of China, the State Administration for Industry and Commerce, the Shanghai High Court, as well as Washington University, College London, Tsinghua University, and Renmin University of China attended the conference.

Professor Wang Xianlin, Executive Vice President of KoGuan School of Law of Shanghai Jiao Tong University and Director of Competition Law and Policy Research Center of Shanghai Jiao Tong University and Professor Zang Dongsheng, Director of the Asian Law Center of Washington University, addressed the welcome of the organizers respectively. Professor Wang Xianlin briefed Chinese and foreign guests on the development history of KoGuan School of Law of Shanghai Jiao Tong University. He said it is important to convene the meeting just after the Shanghai Municipal Party Committee's "Opinion on Accelerating the Construction of a Science and Technology Innovation Center with Global Influence" has just passed: Because the protection of intellectual property and the maintenance of fair competition in the market environment are two important engines for promoting the construction of a scientific and technological innovation center. In his speech, Professor Zang Dongsheng said that the research of KoGuan School of Law of Shanghai Jiao Tong University in recent years has made fruitful achievements in the field of intellectual property and competition law and expressed intentions to strengthen cooperation with KoGuan School of Law in the future. The opening ceremony was presided over by Professor Wan Yong, Assistant to President of KoGuan School of Law of Shanghai Jiao Tong University.

The conference discussed the issues of trademark protection, exterior design and anti-unfair competition law on product design, interface appearance and 3D logo, and had an in-depth discussion on how to carry out case teaching and researches and conduct better classroom interaction between teachers and students.

Module I: "Case law development in major legal systems" is moderated by Professor Toshiko Takenaka, Director of Center for Advanced Studies in Intellectual Property of Washington University. Professor Xuan Thao Nguyen from Law School of Indiana University and Justice Annabelle Bennett from Federal Court of Australia, respectively spoke about well-known design cases in the courts in the United States, as well as relevant provisions of Australian statutory law and classic jurisprudence. Professor Hu Kaizhong from Zhongnan University of Economics and Law, Professor Zhang Yongfan from Law School of Renmin University of China and Ms. Jin Zhaoying of Samsung Electronics Co., Ltd held the post of negotiators.

The second module was chaired by Prof. Hu Jiaxiang, director of Asia Law Center of KoGuan School of Law of Shanghai Jiao Tong University. Prof. Xiang Jing from University of International Business and Economics, Guo Meirong, postdoctoral fellow of KoGuan School of Law of Shanghai Jiao Tong University and Dr. Liang Sisi from Wan Huida Law Office held the post of negotiators. Prof. Robin Jacob from University College London and Andy Culbert of Microsoft respectively made speeches on "Case Law Development on the Protection of Designs in the United Kingdom and the United States" and "Enforcement of IP Laws on Designing Multi-Territories".

Module 3: "Case Law Development in China" was moderated by Associate Professor Hou Liyang of KoGuan School of Law of Shanghai Jiao Tong University. Du Weike, Judge of the third court of civil trial of the Supreme People's Court elaborated on a number of typical cases of appearance design infringement handled by the Supreme People's Court in recent years. Ding Wenlian, Vice President of the Third Trial of Shanghai Higher People's Court, and Du Changhong, Director of Anti-monopoly and Anti Unfair Competition Law Enforcement Bureau of State Administration for Industry and Commerce served as a negotiator and delivered speeches respectively from the perspective of trial practice in Shanghai and enforcement of administrative agencies.

Module 4: "Cross Protection of Intellectual Property Law and Competition Law: Comparing Method Analyzing" was chaired by Professor Chen Xia from Capital Normal University. Jiang Ke from Law School of Tsinghua University, Liu Yongpei from KoGuan School of Law of Shanghai Jiao Tong University made keynote speeches. Zhang Dan from State Administration for Industry and Commerce, Xiong Wencong from Minzu University of China, Gao Jie from Zhongnan University of Economics and Hu Binbin from Law School of Shanghai Jiao Tong University and He Jiong from East China University of Politics and Law and other experts held the post of negotiators and conducted an in-depth discussion on the similarities and differences between the civil law system and Anglo-American law system.

Finally, the closing ceremony was hosted by Lin Yan, vice president of KoGuan School of Law of Shanghai Jiao Tong University. He said that KoGuan School of Law attaches great importance to cooperation with foreign law schools and focuses on the reform of teaching methods. In the future, he hopes to develop further deepen cooperation with other world-class universities including the University of Washington.
